until a signed decree is in hand.
The First Step
Deciding what type of divorce
is right for you. This may sound overwhelming and
scary but we are here to walk you through each type
and explain them to you.
Uncontested Divorce--Both
Parties Agree:
This is by far the easiest
type of divorce. Most people divorce this way. Once
the papers are prepared, both parties will sign the
appropriate forms and file them with the court. Depending
on your state, the divorce should not take long to
become final. This divorce type is only for those
who totally agree on.
Not Sure if Spouse Will
Sign:
This is still pretty simple.
You will have your papers prepared a little differently,
it will be two steps instead of one. Once you have
the first set of papers prepared, you will take them
to the court for filing. Your spouse will be served.
It sounds far worse then it really is, in most states
you can have your spouse served by registered mail.
Your spouse will have a designated amount of time
to respond, this is usually 20-30 days.
If your spouse does not respond
then you will file the final papers called default
papers. This is very simple and this is all included
in our packages.
If you spouse does respond,
you will need to try to work out an agreement with
them. Once an agreement is reached, you will file
the agreement along with the final papers.
Military Divorce
If your spouse is military
and agrees to the divorce, you can do a regular uncontested
divorce. There is an extra form that your spouse will
need to sign. If your spouse doesnt agree to the divorce,
the process is different.
Missing Spouse
If you do not know where your
spouse is and you want to get a divorce, you will
need to do a missing spouse divorce. You will need
to place an ad in the local newspaper for three weeks.
We include all of this and all the information you
need in our missing spouse divorce package.
